• Parental/Guardian Responsibility

Parents or guardians remain solely responsible for the supervision, safety, and well-being of their child or children during all sessions. Under no circumstances may a child be left unattended in the play area or facility.

 

• Liability for Injuries

Messy Celebration Moments will not be held liable for any injuries sustained by children, parents, guardians, or guests while participating in sessions, using equipment, or coming into contact with materials, resources, or food items.

 

• Personal Belongings

Messy Celebration Moments accepts no responsibility for any loss, theft, or damage to personal belongings during a session.

 

• Allergies & Health Risks

Parents or guardians must disclose any allergies or medical conditions their child may have prior to attending a session. They are also responsible for ensuring their child avoids contact with any items that may trigger an allergic reaction, cause harm, or result in illness or accidents. Messy Celebration Moments will not be liable for any incidents arising from failure to disclose such information.

 

• Clothing

Messy Celebration Moments will not be held liable for stains, marks, or damage to clothing. Parents, guardians, and children are strongly encouraged to wear suitable play clothes that can get messy.

 

• Food & Materials

While some products used in sessions may be non-toxic, hypoallergenic, or edible, consumption of any materials or items provided by Messy Celebration Moments is strongly discouraged. Ingestion may still result in illness, allergic reactions, or harm.

 

• Choking Hazards & Supervision

Certain items used in sessions, whether edible or non-edible, may pose choking hazards. Parents or guardians are responsible for supervising their children at all times. Messy Celebration Moments will not be held liable for any accidents, injuries, allergic reactions, illness, or death arising from the use or misuse of items provided during a session.

Waiver and Release from Liability

I/We hereby waive any and all claims that I/We may have now or in the future against Messy Celebration Moments, its owners, officers, trustees, agents, and employees, for any loss, damage, expense, or personal injury, including death, resulting from any cause whatsoever, including but not limited to breach of contract, negligence, or lack of care.

 

I/We agree to indemnify and hold Messy Celebration Moments harmless from any liability for property damage, loss, or injury, including death, to any third party arising from my/our participation in the session.

These terms and conditions shall be binding upon my/our heirs, next of kin, executors, administrators, assignees, and representatives.

 

I/We agree that all obligations arising from this document shall be governed by, and exercised within, the jurisdiction of the session. In the event of any litigation, exclusive jurisdiction shall rest within the area in which the session is held.
